Both the beneficiary and the trustee have elected to sell the real property to satisfy the obligations secured by the trust deed and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.735(3); the default for which the foreclosure is made is grantor’s failure to pay when due the following sums: monthly payments of $708.97 beginning 02/01/2002; plus late charges of $35.45; plus advances of $684.50; together with title expense, costs, trustee’s fees and attorney’s fees incurred herein by reason of said default; and any further sums advanced by the beneficiary for the protection of the above described real property and its interest therein.
By reason of said default the beneficiary has declared all sums owing on the obligation secured by the trust deed immediately due and payable, said sums being the following to wit: $93,288.76 with interest thereon at the rate of 8.25 percent per annum beginning 01/01/2002 until paid, plus all accrued late charges thereon together with title expense, costs, trustee’s fees and attorney’s fees incurred herein by reason of said default; and any further sums advanced by the beneficiary for the protection of the above described real property and its interests therein.
WHEREFORE, notice hereby is given that, FIRST AMERICAN TITLE INSURANCE COMPANY, the undersigned trustee will on Monday December 23, 2002 at the hour of 10:00 a.m. in accord with the standard of time established by ORS 187.110, at the following place: inside the main lobby of the Wallowa County Courthouse, 101 South River Street, in the City of Enterprise, County of Wallowa, State of Oregon, sell at public auction to the highest bidder for cash the interest in the described real property which the grantor had or had power to convey at the time of the execution by grantor of the trust deed, together with any interest which the grantor or grantor’s successors in interest acquired after the execution of the trust deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.753 has the right at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or trust deed, and in addition to paying said sums or tendering the performance necessary to cure the default by paying all costs and expenses actually incurred in enforcing the obligation and trust deed, together with the trustee’s and attorney’s fees not exceeding the amounts provided by ORS 86.753.

In construing this notice, the singular includes the plural, the word “grantor” includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by said trust deed, and the words “trustee” and “beneficiary” include their respective successors in interest, if any.

PUBLIC NOTICE hereby is given that the two-year period for the redemption of real properties included in the 2000 delinquent tax lien foreclosure proceedings instituted by Wallowa County, Oregon, on August 21, 2000, in the Circuit Court of the State of Oregon for Wallowa County, Case No. 00-08-11806, and included in the judgment and decree entered therein on September 29, 2000, will expire on October 28, 2002.
All properties ordered sold under the judgment and decree, unless redeemed on or before October 28, 2002, will be deeded to Wallowa County, Oregon, immediately on expiration of the period of redemption, and every right and interest of any person in such properties will be forfeited to Wallowa County, Oregon.

Notice is hereby given of a regular meeting to be held by the Wallowa County Planning Commission on Monday, Oct. 28 at 7 p.m. in the Courtroom of the Wallowa County Courthouse. The agenda for this meeting will include:

CATHERINE CREEK ALLOTMENT

On Oct. 8, 2002, Forest Supervisor Karyn L. Wood made a decision to implement Alternative Two of the Catherine Creek Allotment Management Plan Environmental Assessment. The project is located approximately 25 miles southeast of LaGrande, Ore. in sections of T.4-5S, R. 41-42E, Willamette Meridian. The project area is in the vicinity of Catherine Creek. This project proposes to update the Catherine Creek Allotment Management Plan, permit regulated grazing of livestock on the Catherine Creek Allotment, construct small sections of drift fence and electric fence to restrict cattle access to sensitive areas, and modify the allotment boundary to remove the private lands along the southern boundaries from the allotment. No new water sources will be developed.
This decision may be appealed by any person(s) or group who has expressed interest in the proposed action or any non-Federal organization or entity that has provided comment by the close of the comment period which ended Oct. 20, 2000 (36 CFR 215.9). In accordance with the provisions of 36 CFR 215.9, a written notice of appeal must be postmarked and submitted within 45 days from the date of publication of this notice in the Baker City Herald newspaper. REQUEST FOR PROPOSALS (RFP)
The City of Wallowa, Oregon, is soliciting Requests for Proposals (RFP), including Statements of Qualifications, from design-build firms for services to be provided for design and construction of a new Emergency Service Building under the design-build contracting method in accordance with OAR 137-040-0520 through 137-040-0560. Based on evaluation of the proposals and competitive negotiations, the City intends to enter into a design-build contract with the final successful design-builder.
For a design-builder to be considered, six (6) copies of the design-builder’s RFP shall be submitted to Marge Sarmento, Mayor, at the City of Wallowa, PO Box 487, 211 East 2nd Street, Wallowa, Oregon 97885. RFP’s must be received no later than 4:00 p.m., Friday, November 22, 2002.
Copies of the complete RFP packet may be obtained after October 18, 2002, from the City of Wallowa upon a non-refundable payment of $50.00 for each set. The design-builders shall provide their mailing address, telephone, fax numbers, and e-mail address when documents are requested.
Because the project is being paid for in part by federal funds, the design-builder will be subject to all federal and state requirements relating to the use of such funds. This project is being funded through a grant from USDA Rural Development.
The contract is subject to all applicable provisions of ORS 279.348 through 279.380 and the Oregon Prevailing Wage Law.
